Consideramos que una reforma y modernización del Estado exige de forma
indispensable un adecuado tratamiento para su recurso más valioso, los servidores públicos,
quienes con su labor diaria aseguran el funcionamiento de las entidades públicas y la
satisfacción de los intereses ciudadanos; y, en consecuencia, con su profesionalización,
permanente capacitación y trato digno procurarán la eficiencia en el servicio civil. Un hito
importante para este objetivo se viene concretando con la aprobación e implementación de la
Ley Nº 30057 – Ley del Servicio Civil, pero también es necesario hacer un análisis sobre la
justicia administrativa en nuestro país.

ABSTRACT
This paper deals with the modernization of public management, in recent years, from
the growing presence of administrative courts in Peru, which offer the possibility of
solving various disputes that arise, rather than resorting to the Judiciary, which
permanently suffers from excessive procedural burden. As such, these courts
represent a valuable and timely mechanism to achieve justice, an inexhaustible claim
of citizenship.
Based on this, we analyze some categories of administrative justice, as well as the
origin and functions of the twelve administrative courts that exist in Peru in 2019,
devoting special attention to the Civil Service Tribunal, which will soon be
celebrating its 10th anniversary uninterrupted operation, and the contributions that
their work has favored in the Employer State.
It occupies our main reflection in this article, the role of the Civil Service Tribunal in
the XXI century. It is up to this court to resolve individual disputes that arise within
the Administrative System of Human Resources Management, in the following
areas: access to the civil service, evaluation and progression in the career,
disciplinary regime and termination of the employment relationship; representing
for public servants a valuable institution to obtain a pronouncement on situations that
pertain to their performance in the public sector: Public competitions of merits,
permits, licenses, transfers, application of sanctions.
We believe that a reform and modernization of the State requires an adequate
treatment for its most valuable resource, public servants, who with their daily work
ensure the functioning of public entities and the satisfaction of citizens' interests;
and, consequently, with their professionalization , permanent training and
